Terms of Service

1. Acceptance of Terms
By accessing or using the Restaurant Fire LLC ("Restaurant Fire," "we," "us," or "our") website, application, and API (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Service Description
Restaurant Fire provides web-based restaurant management software including online ordering, SMS marketing, website building, review management, and POS integration services for pizzerias and restaurants. You must be of legal age to create an account and use our services.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Content Ownership
User-submitted data (menus, customer information, orders, etc.) remains your property. However, you grant Restaurant Fire a non-exclusive, royalty-free, transferable right to use, display, perform, reproduce, and distribute content as necessary for service operation.
5. Prohibited Content and Conduct
Users agree not to:
- Post unlawful, defamatory, obscene, harassing, or infringing material
- Send spam or unsolicited commercial messages
- Attempt to gain unauthorized access to our systems
- Use the Service for any illegal purpose
- Interfere with the proper functioning of the Service
6. Payment Terms
Certain features require payment. By subscribing, you agree to pay all fees associated with your selected plan. Fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice.
7. Third-Party Services
Restaurant Fire integrates with third-party services including payment processors (Stripe, Clover) and other platforms. You must review and agree to those providers' terms separately. Restaurant Fire disclaims liability for third-party services.
8. Security Disclaimer
While Restaurant Fire uses encryption, SSL certificates, and industry-standard security measures, we acknowledge that no system is perfectly secure or reliable. The Internet is an inherently insecure medium. You use the Service at your own risk.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
IN NO EVENT SHALL RESTAURANT FIRE'S AGGREGATE LIABILITY EXCEED THE AMOUNTS PAID BY YOU FOR THE SERVICE DURING THE PREVIOUS THREE MONTHS. IN NO EVENT SHALL RESTAURANT FIRE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
11. Indemnification
You agree to indemnify and hold harmless Restaurant Fire LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
12. Account Termination
Inactive accounts (2+ months without activity) may be deactivated. You may terminate your account at any time but must pay any remaining fees for the current billing period. We reserve the right to terminate accounts that violate these Terms.
13. Dispute Resolution
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration rather than court proceedings. You waive the right to participate in class-action lawsuits.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
